1. Acceptance of Terms

By accessing or using the Moche device, the Moche Hub web portal (hub.moche.world), the Moche website (moche.world), or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.

These Terms constitute a legally binding agreement between you and Moche ("Company," "we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the Services after changes constitutes acceptance of the updated Terms. We will notify you of material changes via email or through the Moche Hub.

2. Eligibility

You must be at least 18 years old to create a Moche account and subscribe to the Services. If you are between 13 and 17 years old, you may use Moche only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. Children under 13 may not use the Services.

3. Account Registration

To use the Services, you must create a Moche account through the Moche Hub (hub.moche.world). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

You must notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. Moche Device

The Moche device is a consumer electronics product sold as-is at the point of purchase. The device is designed to work with the Moche subscription service. While the device hardware is yours to keep, certain features require an active subscription to function, including but not limited to: AI voice assistant, cellular connectivity, cloud storage, phone number service, and access to the Moche Hub.

The device contains an embedded eSIM that is provisioned and managed by Moche. The phone number assigned to your device is provided through our carrier partner and is subject to the terms of our carrier agreement. You may port your existing phone number to Moche or port your Moche number to another carrier, subject to standard industry porting procedures.

5. Subscription Service

The Moche subscription is billed at $24.99 per month. Your subscription includes: AI voice assistant access, a dedicated phone number, 4G cellular data, cloud storage for photos, memories, and conversations, full access to the Moche Hub, and over-the-air software updates.

Your subscription begins when you activate your Moche device and create your account. You will be billed monthly on the anniversary of your activation date. All fees are non-refundable except as expressly stated in these Terms or as required by applicable law.

We reserve the right to change subscription pricing with 30 days advance notice. Any price changes will take effect at the start of your next billing cycle following the notice period.

6. Cancellation and Refunds

You may cancel your subscription at any time through the Moche Hub or by contacting our support team. Upon cancellation, your subscription will remain active through the end of your current billing period. After cancellation, the following services will be discontinued: AI voice assistant, cellular connectivity, phone number service, cloud sync, and Moche Hub access.

After cancellation, your Moche device will retain basic functionality over WiFi connections only, including local settings and any data stored on the device. Cloud-stored data (photos, memories, conversations) will be available for download for 30 days after cancellation, after which it may be permanently deleted.

The Moche device hardware purchase is covered by a 30-day return policy from the date of delivery. To initiate a return, contact our support team. The device must be in its original condition with all included accessories. Shipping costs for returns are the responsibility of the customer unless the device is defective.

7. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to: (a) Use the Services for any illegal or unauthorized purpose; (b) Attempt to reverse engineer the Moche device firmware or cloud software; (c) Interfere with or disrupt the Services; (d) Use the Services to transmit malware or harmful code; (e) Resell or commercially exploit the Services without written consent; (f) Use the cellular service for purposes other than personal use.

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms.

8. AI Services and Limitations

The Moche AI assistant is provided for informational and convenience purposes only. AI responses are generated by third-party AI models and may not always be accurate, complete, or appropriate. You acknowledge that: (a) The AI assistant is not a substitute for professional advice; (b) AI responses may contain errors; (c) The AI models may change over time; (d) In an emergency, always contact 911 directly.

9. Cellular Service

Cellular voice, text, and data services are provided through our mobile virtual network operator (MVNO) partner. Coverage, speed, and availability depend on the underlying carrier network and may vary by location. We do not guarantee uninterrupted or error-free cellular service.

Your cellular data usage is subject to reasonable use limits. The phone number assigned to your Moche device remains the property of the carrier network. You have the right to port your number to another carrier in accordance with FCC regulations.

10. Intellectual Property

The Moche name, logo, device design, software, firmware, website content, and all related intellectual property are owned by the Company and are protected by copyright, trademark, patent, and other intellectual property laws. Content you create using the Services (photos, voice messages, etc.) remains your property.

11. Third-Party Services

Moche integrates with third-party services such as Spotify, Apple Music, and others through the Moche Hub. Your use of these third-party services is governed by their respective terms of service and privacy policies.

12. Warranty and Disclaimer

The Moche device is covered by a limited one-year hardware warranty from the date of purchase covering defects in materials and workmanship under normal use. Silicone skins are considered consumable accessories and are not covered.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless the Company from and against any claims, damages, losses, liabilities, costs, and expenses arising out of your use of the Services, your violation of these Terms, or your violation of any rights of any third party.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Nevada. Any dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in Clark County, Nevada.

YOU AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS ACTION. You may opt out of arbitration by sending written notice within 30 days of creating your account.
